Notice of Privacy Practices
Creative Path to Healing, LLC is committed to protecting your privacy. Creative Path to Healing, LLC is required by federal law to maintain the privacy of Protected Health Information (“PHI”), which is information that identifies or could be used to identify you. Creative Path to Healing, LLC is required to provide you with this Notice of Privacy Practices (this “Notice”), which explains Creative Path to Healing, LLC’s legal duties and privacy practices and your rights regarding PHI that we collect and maintain.
YOUR RIGHTS
Your rights regarding PHI are explained below. To exercise these rights, please submit a written request to Creative Path to Healing, LLC at the address noted below.
To inspect and copy PHI
You can ask for an electronic or paper copy of PHI. Creative Path to Healing, LLC may charge you a reasonable fee.
Creative Path to Healing, LLC may deny your request if it believes the disclosure will endanger your life or another person’s life. You may have a right to have this decision reviewed.
To amend PHI
You can ask to correct PHI you believe is incorrect or incomplete. Creative Path to Healing, LLC may require your request in writing and a reason for the request.
Creative Path to Healing, LLC may deny your request and will provide a written explanation and allow you to submit a written statement of disagreement.
To request confidential communications
You can ask Creative Path to Healing, LLC to contact you in a specific way. Creative Path to Healing, LLC will say “yes” to all reasonable requests.
To limit what is used or shared
You can ask Creative Path to Healing, LLC not to use or share PHI for treatment, payment, or business operations. Creative Path to Healing, LLC is not required to agree if it would affect your care.
If you pay for a service or health care item out-of-pocket in full, you can ask Creative Path to Healing, LLC not to share PHI with your health insurer.
You can ask Creative Path to Healing, LLC not to share your PHI with family members or friends by stating the specific restriction requested and to whom it applies.
To obtain a list of disclosures
You can ask for a list (an accounting) of times your health information has been shared. One accounting every 12 months is provided at no charge; additional requests may incur a reasonable fee.
To receive a copy of this Notice
You can ask for a paper copy of this Notice at any time, even if you agreed to receive it electronically.
To choose someone to act for you
If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights.

To opt out of fundraising communications
Creative Path to Healing, LLC may contact you for fundraising efforts, but you may request not to be contacted again.
OUR USES AND DISCLOSURES
1. Routine Uses and Disclosures of PHI
Creative Path to Healing, LLC is permitted under federal law to use and disclose PHI without your written authorization for treatment, payment, and healthcare operations.
To treat you
We may use and share PHI with other professionals involved in your care.
Example: Your primary care provider asks about your mental health treatment.
To run healthcare operations
We may use PHI to run our practice, improve care, and contact you.
Example: Appointment reminders, if you choose.
To bill for services
We may use and share PHI to bill and obtain payment from health plans or other entities.
2. Sensitive Health Information, Including Women’s & Reproductive Health
Some health information—such as information related to reproductive health, pregnancy, fertility, sexual health, or gender-related care—may be considered particularly sensitive.
Creative Path to Healing, LLC treats all PHI, including sensitive health information, with confidentiality and care in accordance with federal HIPAA regulations and applicable state laws. We do not disclose such information without your authorization except as permitted or required by law, including for treatment, payment, healthcare operations, or mandatory reporting obligations.
Privacy laws related to reproductive and women’s health information may evolve over time. Creative Path to Healing, LLC complies with current federal and state privacy laws in effect at the time services are provided.
3. Uses and Disclosures of PHI Without Authorization or Opportunity to Object
Creative Path to Healing, LLC may use or disclose PHI without your authorization for:
Public health and safety
Preventing disease spread
Reporting adverse reactions
Compliance reviews by HHS
Health oversight activities
Preventing serious and imminent threats
Reporting abuse, neglect, or domestic violence as required by law
Legal and governmental purposes
Required by law
Court orders or subpoenas
Law enforcement requests
Military, national security, or intelligence activities
Workers’ compensation claims
Other permitted disclosures
Coroners and funeral directors
Organ donation
Approved research
Inmate healthcare
Business associates performing services on our behalf
4. Uses and Disclosures With Opportunity to Object
Unless you object, we may disclose PHI:
To family members, friends, or others involved in your care
When it is in your best interest and you are unable to state your preference
5. Uses and Disclosures Requiring Written Authorization
Written authorization is required for:

Sale of PHI
Psychotherapy notes
You may revoke authorization at any time in writing.

Creative Path to Healing, LLC is required by law to maintain the privacy and security of PHI.
We must follow the terms of this Notice currently in effect.
Where more stringent state or federal law applies, we follow the stricter law.

We will notify you if your PHI is compromised in a breach.
